The following data/documents are required for filing a PATENT application in Belarus:
In case of a Convention Patent application:
- Name(s) and address(es) of the author(s) and the applicants(s);
- Specification of the application (including description, the claims and an abstract);
- Drawings (if needed and if they are referred to in the specification);
- Power of attorney simply signed on behalf of the applicant(s) with indication of the full name and position of the signatory; neither legalization nor notarization is required;
- Certified copy of the first application(s).
Notes:
- When claiming Convention priority in Belarus the Belarusian convention application should be filed at the Belarusian Patent Office within 12 months after the filing date of the first application in a State - party to the Paris Convention.
- The maximal term of a patent validity amounts to 20 years from the date of filing the application with the Patent Office.
- Alternatively, an invention can be protected in Belarus by a Eurasian patent. For detailed information see Eurasian patents.
In case of entering the national phase of a PCT application:
- All documents of PCT application as published including specification, claims, abstract, and drawings; filing date(s) and serial number(s) of the Priority application(s); full name and address of the Applicant; full name(s) and address(es) of the inventor(s);
- Power of Attorney
Notes:
- PCT applications shall enter the National Phase in Belarus within 31 months from the priority date.
- Alternatively, an invention disclosed in a PCT application can be protected in Belarus by a Eurasian patent. For detailed information see Eurasian patents.
