Copyright

Copyright in Russia is based principally on the Constitution of the Russian Federation, the Civil Code and the Law of the Russian Federation "On Copyright and Related Rights" dated July 09, 1993 and amended on July 28, 2004. Besides, Russia is a contracting party of a number of International treaties in the sphere of copyright.

On July 28, 2004 some significant amendments were made to the Russian Law "On Copyright and Related Rights":

  • the term of protection of copyright was extended from 50 to 70 years after the author's death;
  • the exclusive right of the author to communication to the public by wire or wireless means now includes the right of making available to the public of their works in such a way that members of the public may access these works from a place and at a time individually chosen by them;
  • new articles 481 and 482 were added. The article 481 contains statements on technical means of protection of copyright and related rights. The article 482 regulates information on copyright and related rights;
  • article devoted to sanctions for infringement of copyright and related rights was formulated in a new way. The amount of indemnity that may be demanded from the infringer, is established in rubles (Russian national currency), not in terms of minimum salary as before. Now the owner of infringed rights may get from 10 000 rubles (about USD 358) to 5 000 000 rubles (about USD 178 575) by the decision of the court.
